"Smartest" is deeply committed to compliance with Spanish and European legislation on the protection of personal data, and guarantees full compliance with the obligations established, as well as the implementation of the security measures provided for in the General Data Protection Regulation, Regulation (EU) 2016/679 of 27 April (GDPR), and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPD y GDD, the Spanish Data Protection and Digital Rights Act; hereinafter, the LOPD).
In accordance with these regulations, we inform you that the use of our website may require the provision of certain personal data through registration or contact forms, or by sending emails, and that such data will be processed by "Smartest", the Data Controller, whose details are:
Personal data is any information relating to a person: name, email address, postal address, telephone number, NIF/NIE... Additionally, when a User visits our website, certain information is stored automatically for technical reasons, such as the IP address assigned by their Internet access provider.
"Smartest", as Data Controller, has a duty to inform the Users of its website about the collection of personal data that may take place, whether by sending an email or by completing the forms included on the website.
Only the data necessary to provide the contracted service, or to respond adequately to the request for information made by the User, will be collected. The data collected are identification data and correspond to a reasonable minimum required to carry out the activity concerned. In particular, specially protected data are not collected at any time. Under no circumstances will the data be used for any purpose other than that for which they were collected.

Both providers are based in the United States, so submitting these forms involves an international transfer of data. Such transfers are carried out with the safeguards provided for in the GDPR (standard contractual clauses and/or adequacy mechanisms in force), in accordance with the privacy policies published on the respective websites of those providers.
Only persons over 14 years of age may provide personal data on this website. As required by the LOPD y GDD, in the case of minors under 14, the consent of their parents or guardians will be a mandatory condition for us to process their personal data.
Furthermore, only persons over 18 years of age may contract our services. In the case of minors under 18, the consent of their parents or legal guardians will be a mandatory condition for us to provide the services offered, unless the minor is emancipated.
Once "Smartest" services have been contracted, the User must create a personal account by assigning a specific email address and a password, which must meet the security requirements defined by "Smartest", in addition to providing their identification details (first name and surname). Access credentials, such as the email address and password, do not expire, unless the User wishes to change them or requests it for security reasons.
If the password is forgotten, the User can reset it by accessing the recovery form available on the website. To start the recovery process, they must enter their registered email address, after which they will receive a link to create a new password and restore access to their account.
The User is responsible for maintaining the confidentiality of their password, as well as for all activities carried out from their account. If any unauthorised use of their account or password is detected, the User must inform "Smartest" as soon as possible, by contacting info@smartestglobal.com or through the communication channels available on the platform.
Once registered, the User will have access to a private dashboard from which they can view specific content and manage various account options, such as updating their personal data or changing their password. The options and content accessible in the private area will depend on the role assigned to the User, and may include or restrict the display of certain functions, information or documents according to the needs of the contracted service.
User accounts at "Smartest" will remain active for the duration of the contracted service and are not deleted due to inactivity; however, the User may request the cancellation of their account at any time by sending an email to info@smartestglobal.com or by using the options available in their profile.
"Smartest" reserves the right to temporarily or permanently block a User account if suspicious or fraudulent activity is detected. By registering, the User accepts that the owners of this website may, at any time and without prior notice, modify or suspend the site's services, as well as remove information provided by the User, whether temporarily or permanently.
Users of the "Smartest" website are informed that all necessary technical and organisational security measures within our reach have been adopted to prevent the loss, misuse, alteration, unauthorised access and theft of personal data, thereby guaranteeing the confidentiality, integrity and quality of the information held, in accordance with the provisions of the data protection legislation in force.
In accordance with the provisions of Article 28 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter, the "GDPR"), and Article 33 of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights ("LOPD-GDD"), the User is informed that "Smartest" applies the necessary measures for the processing of data on behalf of third parties. The general security measures implemented include access control systems, secure password policies, restricted access permission management protocols and regular security audits, in order to ensure complete and continuous protection of the personal data stored and processed. Additionally, the "Smartest" Website also has SSL encryption, which allows the User to send their personal data securely.
The User declares that all data provided by them are true and correct and undertakes to keep them up to date. The User is answerable for the accuracy of their data and will be solely liable for any disputes or litigation that may arise from any inaccuracy in them. It is important, so that we can keep personal data up to date, that the User informs "Smartest" whenever there has been any change to them.

Data disclosures will take place under the strictest confidentiality, using the necessary measures, such as the signing of confidentiality agreements or adherence to the privacy policies published on their respective websites. The LOPD y GDD and the GDPR grant data subjects the possibility of exercising a series of rights related to the processing of their personal data. To do so, the User must contact us by email at info@smartestglobal.com, or by written communication to the address shown in our Legal Notice, providing adequate identification. That communication must include the following information: the User's first name and surname, the subject of the request, their address and supporting identification details.
Rights must be exercised by the User themselves. However, they may be exercised by a person authorised as the User's legal representative, provided that documentation evidencing such representation is supplied.

The personal data of Users who send us an email requesting information will be processed for the time strictly necessary to deal with the request for information, or as necessary for the performance of the contract, and will be used exclusively to manage the legal relationship existing between the parties for as long as it remains in force, or until the consent given is withdrawn.
